Kaduna passed its Shariah Courts Law in 2001, and its Sharia Criminal Procedure Code Law was signed on 21 June 2002 and published in the state gazette together with the Sharia Penal Code.
Who it applies to
The Sharia penal codes apply only to Muslims. Sharia courts hear criminal cases only if the accused is Muslim, and a non-Muslim can come under them only by voluntarily accepting it.
What it says on gambling
The harmonised Sharia penal code text lists gambling offences: playing a game of chance for money in a public place, keeping a place for betting or gambling, and running a lottery office, with forfeiture on conviction.
What the penalty is
The harmonised text sets up to 6 months, 15 lashes or a fine for these offences. For Kaduna the source footnotes label the punishment as ta'azir, meaning it is left to the judge's discretion.
One caution: those section details come from the harmonised model text, and we could not confirm Kaduna's own section numbers, so we do not quote any. Kaduna is also described as mixed. Reports from the early 2000s said it was divided into Sharia-compliant and non-Sharia areas, with customary courts handling non-Muslims, and that the Sharia courts were weakly used in practice. Treat that as history, not as a guide to today.
Some local councils have also passed their own bye-laws. Giwa Local Government has banned gambling across the whole council area, with a fine of up to ₦20,000 or up to two years for a first offence, and Makarfi Local Government made any gambling an offence and banned running a gambling house. These are local rules for those two councils, not statewide law.

The code follows the person, not the place. A Muslim is covered wherever they are in the state, and a non-Muslim is covered by the general state law.
How Kaduna Licenses and Taxes Gaming
Gaming in Kaduna is regulated by the Penal Code Law of Kaduna State 2017 and the Kaduna State Tax (Codification and Consolidation) Law 2020. Under sections 172 to 174 of the 2017 law, anyone operating gambling, betting or games of chance must obtain a licence. Part X of the 2020 tax law sets the licensing conditions and names the Kaduna Internal Revenue Service (KADIRS) as the gaming regulator. We did not find a separate Kaduna lottery or gaming board.
The offence and the licence
The 2017 Penal Code Law makes unlicensed gambling operations an offence and requires a licence.
The conditions
Part X of the 2020 tax law sets the licensing conditions for gaming operators.
The regulator
KADIRS, the state revenue service, is the named gaming regulator, so licensing and tax sit with one body.
The fee
Section 86 of the state tax law asks for a non-refundable registration fee of ₦400,000 from gaming operators.
The best known example is September 2020. Over three days, KADIRS sealed 13 betting shops (5 Bet9ja, 5 King Bet, 2 Access Bet and 1 Derby Lotto outlets) for not being registered. Reports said about 1,500 gaming offices were operating unlicensed, that the claimed tax liability was about ₦500 million, and that operators were given 14 days to regularise. It was a licensing and tax action, not a Sharia or Hisbah ban, and it tells you how the state sees the business side: as something to register, license and tax.

Lagos has a dedicated body, the Lagos State Lotteries and Gaming Authority (LSLGA), created by the Lagos State Lotteries and Gaming Authority Law 2021. It regulates internet and traditional gambling, including casinos, sports betting and lotteries. Kaduna has no equivalent standalone authority that we could confirm: licensing runs through the Penal Code Law and the tax law, with KADIRS in charge, and the Sharia penal code applies on top of that to Muslims.
On 22 November 2024 the Supreme Court gave a unanimous judgment in the case between the Attorney General of Lagos State and others and the Attorney General of the Federation (suit SC/1/2008). It held that lottery is a residual matter for the states, so the National Lottery Act 2005 cannot apply inside states and works only in the FCT. The National Lottery Regulatory Commission can now license only businesses operating in the FCT. Everyone else needs a state licence.
For Kaduna this means the state laws above are the ones that count. We found no new Kaduna gaming law passed after the judgment. Other states reacted differently: the Kano Hisbah said on 23 November 2024 that it would resume its clampdown on betting shops. Rules differ from state to state, so never assume that what is true in Lagos or Kano is true in Kaduna.
